Abstract
Il testo affronta le vicende storico-evolutive dell’istituto del foro interno nell’ordinamento canonico. L’autore prende le mosse da alcuni aspetti di natura biblica e teologica che hanno influito in maniera più o meno diretta sull’istituto, con particolare riferimento alla prassi penitenziale. Si passa poi all’indagine dello sviluppo dell’istituto nel corso del Medioevo, prendendo a riferimento sia testi canonistici che teologici, stante l’intreccio che viene a crearsi, nel periodo storico preso in esame, tra teologia e diritto. Il Concilio di Trento rappresenta una tappa fondamentale nel percorso evolutivo che porta alla definizione dell’istituto del foro interno in senso moderno; le disposizioni tridentine troveranno in Suarez e negli esponenti della Seconda Scolastica i loro principali divulgatori e, per ciò che attiene il foro interno, sarà proprio la sistematizzazione del maestro granadino a fissarne i principali capisaldi. Dopo avere ripercorso l’iter evolutivo dell’istituto in epoca moderna ed il suo inserimento nelle codificazioni canoniche del Novecento, il testo delinea, infine, l’attuale disciplina del foro interno dando conto di come esso rappresenti oggi una delle caratteristiche peculiari dell’ordinamento giuridico ecclesiale. The text deals with the genesis and the historical evolution of the institution of the internal forum in the canonical juridical system. The author starts from some aspects of a biblical and theological nature that had an influence on the institution with particular reference to the penitential practice. The text then moves on to the investigation of the development of the institution during the Middle Ages, referring to both canonical and theological texts of this period. The Council of Trent represents a fundamental step in the evolutionary path that led to the definition of the institution of the internal forum in the modern sense; the Tridentine dispositions found their main disseminators in Suarez and in the exponents of the Second Scholasticism and, for what concerns the internal forum, it was precisely the systematization of the Granadian master that established its main cornerstones. After retracing the evolutionary process of the institution in the Modern Era and its inclusion in the canonical codifications of the Twentieth Century, finally the text outlines the current discipline of the internal forum by giving account of how it today represents one of the peculiar characteristics of the canonical legal system.
