Abstract

La promulgazione della legge n. 9 del 17 febbraio 2012 e del Decreto Legge n. 52 del 31 marzo 2014 ha costituito un’autentica novità all’interno del panorama della psichiatria italiana e del trattamento della malattia mentale, sancendo il definitivo superamento degli Ospedali Psichiatrici Giudiziari (OPG). Questo epocale cambiamento, che non può che essere salutato positivamente in quanto porterà ad una radicale trasformazione dell’assistenza e della riabilitazione dei soggetti autori di reato giudicati non imputabili per vizio mentale, si evidenzia, tuttavia, come un percorso tutt’altro che semplice in quanto dalle previsioni del legislatore emergono numerosi punti di debolezza che, se non affrontati criticamente, possono inficiare la portata del progetto complessivo. A tale riguardo l’autore, alla luce dell’attuale normativa, affronta le problematiche più evidenti riguardanti la tipologia delle strutture alternative agli OPG (le cosiddette Residenze Esecuzione Misure di Sicurezza-REMS), la necessità di potenziare l’attività dei Dipartimenti di Salute Mentale (DSM) per favorire il più possibile i percorsi territoriali, il potenziamento della salute mentale nelle carceri, il problema della riforma del codice penale in merito ai temi dell’imputabilità e della pericolosità sociale. La promulgation de la loi n°9 du 17 février 2012 et du décret législatif n°52 du 31 mars 2014 constitue une nouveauté dans le panorama de la psychiatrie italienne et du traitement de la maladie mentale. En effet, ces normes établissent le dépassement définitif des hôpitaux psychiatriques judiciaires italiens. Ce changement historique a été accueilli de manière très positive car il va entraîner une transformation radicale de l’assistance et de la réhabilitation des délinquants jugés irresponsables du point de vue pénal pour cause d’aliénation mentale. Il convient cependant de noter que la route est encore longue parce que la loi révèle ses faiblesses qui, sans lecture critique, peuvent affecter la portée globale du projet. Dans ce sens, l’auteur de l’article, sur la base de la législation actuelle, aborde les problèmes suivants qui sont, entre autres, les plus évidents : les structures alternatives aux hôpitaux psychiatriques judiciaires (ce que l’on appelle REMS – Résidences pour l’Exécution des Mesures de Sûreté) ; la nécessité de renforcer les activités des Départements de Santé Mentale afin de favoriser les soins territoriaux ; le renforcement de la fourniture de services de soins mentaux en prison ; le problème de la réforme du Code Pénal en ce qui concerne les aspects de l’irresponsabilité pénale et de la dangerosité sociale. The entrance into force of the Law No. 9 of 17th February, 2012 and Legislative decree No.52 of 31st March , 2014 brought about a new scenario of Italian psychiatry and treatment of mental illness. In fact, this marks the end of Judiciary Psychiatric Hospitals. The historic change has received positive comments because it will lead to a radical transformation of assistance and rehabilitation of offenders found not guilty due to mental illness. It should be noted , however, that the next few steps are far from easy because the law shows numerous weaknesses that, if not critically addressed, may affect the overall scope of the project. In this respect, the author of this article, on the basis of the current legislation, deals with the most evident issues concerning the following: alternative structures to Judiciary Psychiatric Hospitals (the so-called REMS); the need to strengthen the activities of the Department of Mental Health in order to encourage territorial mental health care as much as possible; the improvement of mental health care in prisons; the issue of the reform of the articles of the Criminal Code dealing with indictable and social dangerous people.
