Abstract

Con il presente articolo si intende fornire un resoconto delle politiche europee di contrasto al terrorismo e al cyber-terrorismo attivate a partire dal 2001, anno dell'attentato di New York alle Torri Gemelle, al fine di identificare i cambiamenti che sono avvenuti a seguito dei principali attacchi terroristici di questo inizio secolo (tra cui quelli di Madrid nel 2004, Londra nel 2005, Oslo e Utøya nel 2011, Tolosa e Montauban nel 2012, Boston nel 2013). A partire dal dibattito accademico internazionale sulla definizione di terrorismo e di cyber-terrorismo, sono stati messi in evidenza gli attuali tratti distintivi del fenomeno in esame, tenendo conto della sua evoluzione e delle forti implicazioni tecnologiche. I nuovi connotati del terrorismo, peculiari rispetto al passato, hanno imposto nuove strategie di contrasto a livello nazionale e internazionale. Ci si è dunque soffermati sulle politiche europee in materia di lotta al terrorismo e al cyber-terrorismo, nonché sulle principali fonti normative rese nell’UE e in Italia, ponendo altresì in evidenza i problemi legati alla ricerca del delicato equilibrio tra esigenza di sicurezza, da un lato, e tutela delle libertà fondamentali e dell’ordinamento democratico, dall'altro lato. Cet article a pour but de passer en revue les politiques européennes pour combattre le terrorisme et le terrorisme cybernétique, qui ont été adoptées à partir de 2001, suite à l’attentat des tours jumelles à New York. L’objectif est d’identifier les modifications survenues après les grands attentats terroristes du début de ce siècle (Madrid en 2004, Londres en 2005, Oslo et Utøya en 2011, Toulouse et Montauban en 2012, Boston en 2013). En partant du débat académique sur la définition du terrorisme et du terrorisme cybernétique, cet article met en évidence les traits actuels de ce phénomène, en tenant compte de son évolution et des implications de la technologie. Les nouveaux signes distinctifs du terrorisme, différents par rapport au passé, ont imposé le développement de nouvelles stratégies à échelle nationale et internationale pour le combattre. Après quoi, l’article fait le point sur les politiques italiennes et européennes, en soulignant les problèmes relatifs à l’équilibre fragile entre les besoins de sécurité et la sauvegarde des libertés et de la démocratie. This article is a review of European policies towards the fight against terrorism and cyber-terrorism that has been operating since 2001, the year of the win Tower's attack in New York. Its aim is to identify changes occurred after the major terrorist attacks of the beginning of this century (Madrid in 2004, London in 2005, Oslo and Utøya in 2011, Toulouse and Montauban in 2012, Boston in 2013). Starting from the international academic debate about the definition of terrorism and cyber-terrorism, the article highlights the current traits of this phenomenon, with an interest towards the massive effects of its technological evolution. The new distinguishing marks of terrorism, different from the past, have imposed the development of new strategies at national and international levels in order to fight against it. Afterwards, the article focuses on Italian and European policies, underlying the problems regarding the delicate balance between security needs and protection of basic freedoms and democracy.
